Patriots Being Denied Gun Ownership

While I believe it’s the private property right of any business owner to decide who he/she sells to … or not, here’s a troubling situation.  Because the government has required gun dealers to put their customers through background checks, more and more citizens – based on the arbitrary rules and regulations that government sets –  are being denied the right to purchase a gun.

It’s time for citizens to take the initiative to be vigilant, to follow up, and to exercise Constitutional rights.  It’s time for gun dealers to unite and protest against the government’s unconstitutional policies.  It’s time for citizens to work together with those dealers, to back them up, to unite in what is right.

We need organizations such as Gunowners of America to take a Constitutional stand.

And the NRA…. well, honestly I don’t hold out much hope there because the NRA has agreed to putting these regulations into the hands of federal bureaucrats in the first place.  It’s time for the NRA to read the entire Constitution, not just the Second Amendment and to start doing the right thing, not just padding their pockets with big donations.

Finally. An attorney has taken the Offense. On Monday, May 9, 2016, Larry Klayman, Cliven Bundy’s attorney, issued an advisory informing federal Judge Navarro, Senator Harry Reid and his son Rory, and President Obama that they have violated his client’s, Cliven Bundy’s constitutional rights – the very rights we have been discussing on The Liberty Lineup Radio Show. Today, Cliven Bundy filed a complaint against U.S. District Court Judge Gloria Navarro, U.S. Senator Harry Reid, the son of Harry Reid, Rory Reid and President Barack Obama for allegedly violating his Sixth Amendment Right to Counsel and For Speedy Trial, Eighth Amendment Right Against Cruel and Unusual Punishment (Mr. Bundy is currently being held in solitary confinement), Second Amendment Right to Bear Arms in Self-Defense, and First Amendment Right to Assemble in Self-Defense. The complaint asks the Court to dismiss the indictment against Cliven Bundy and release him from prison and solitary confinement.

Cliven Bundy’s attorneys will discuss the complaint following the hearing at 10:00 a.m. on the courthouse steps.

Meanwhile, Angie Bundy, Cliven’s daughter-in-law and wife of Ryan Bundy, will be on the radio with us at the time of this hearing to discuss her husband’s letter and the help they need.

Angie delivered to me a letter from her husband Ryan Bundy that I hand-delivered to Senator Mike Lee, Congressman Chris Stewart and to Utah Attorney General Sean Reyes the weekend of the Utah State Republican Convention. Ryan and Angie own a business and land in Cedar City. Ryan was taking a constitutional stand at the Malheur Wildlife Refuge in Oregon. Here is what he wrote from his jail cell:

Historical Introduction

Hello, this is Ryan Bundy. I am the eldest son of Cliven Bundy of Riverside, Nevada. I lived in Cedar City, Utah for eighteen years while owning and operating a construction company. I still own a home in Cedar City, and my business license is still active in Utah.

My home and heart are still in Nevada, where I was born and raised. I grew up on a cattle ranch that my ancestors settled along with the towns of Bunkerville, and Mesquite. This all took place when the Saints were sent to the Virgin River Mission in 1877. We have raised good beef on that land ever since that time. My roots are deep into its soil, and my grandfathers are buried there.

Although Utah was settled years before Nevada, Nevada became a state of the union first on October 31, 1864. This was because of political oppression on the Mormon people from the US Government. They did not want Utah to gain the Liberty that a state has. If they could keep Utah as a territory they could maintain much more control over them. Nevada, Arizona, Colorado, Idaho, Wyoming all became states first whittling away at the territory of Utah and then finally, Utah was allowed statehood.

Nevada was made a state by President Abraham Lincoln who stated in his speech to accept Nevada into the Union that Nevada enters into the union equal in every way to the original 13 states. This was consistent with the equal footing doctrine, the Northwest ordinances and Article IV of the US Constitution.

What does that mean to be on equal footing with the original thirteen states? Well, to answer that, one must first understand what a “state” is. The definition of a state is the same definition of a nation. The two terms are synonymous. A state is not merely a province. It is its own geographical and political sovereignty. After the War for Independence was won, America was made up of thirteen independent and sovereign nations or states as we would call them. Proof of this is in the signing of the Treaty of Paris. There was no “United States of America” just yet.

The “Treaty of Paris” is the peace treaty that officially ended the War for Independence with Great Britain, and was first signed in Paris (thus, its name). This treaty was signed by 14 states. The language in the treaty made it clear that all 14 states were equal in every wit in standing in the world. So who was the 14th state to sign the treaty? Were there not only 13 states to win their Independence? The answer is this; Great Britian was the 14th state to sign. 13 separate and independent nations/states were now equal individually and separately with Great Britain in the standing of the world. Their intent was to unite, and they did under the Articles of Confederation, and later under the Constitution of the United States. Before they united, they were separate and completely independent states. Each of them had all the rights, privileges, and ownership of all the land within their boundaries. The same as any other nation in the world would have.

So, now I would ask, how much land in each state did Great Britain retain? How much land in each state did Great Britain control or retain after their independence? None of course…they were states, equal in standing in the world…Great Britain could not own any of it…they didn’t control one square foot.

So, back to Nevada. It was made a state in 1864 upon equal footing with the original 13 states. Equal in every way according to President Lincoln, and according to the Constitution. This means that all of its land belongs to that state and none of it retained by another. One must realize that the United States is not a state alone, rather it is a union of several states. United for particular reasons outlined in it’s Constitution.

States that join the union do so for the protections and benefits of being a member of it. But, each state is still a free and independent nation voluntarily joined in this union for specific purposes. The overall purpose for the union is to provide protection from the outside world, to prevent invasion. Our founding fathers understood a few things that we seem to have forgotten. They understood that the land and the resources belong to individuals and not governments. When any government begins to own and control the land and resources, people begin to suffer while the government grows powerful. Our founding fathers had just fought a long and bloody war to free themselves from a monstrous government that claimed all the land and resources in America. They were not going to create another government like it. No, not even close.

Through our Constitution, they clearly stated that the people are the sovereign. The Government does not have any power in and of itself. Only as “herein granted” does the people afford the government any power at all. Our founding fathers made sure that the only land that the Government could own was only enough to fulfill the tasks that we had given it to perform. Nothing more. The land and resources does and has always belonged to the people-individuals. Article I Section 8 Clause 17 allows Congress to have a 10 mile square for the seat of Government (Washington DC) and to purchase with the state legislators’ consent, land that can be used for five purposes only. “For the erection of forts, magazines, dock yards, and other needful buildings.” Nothing more. The constitution does not allow the federal government to own any other land other than those listed here. These lands allow the federal government to fulfill the purposes and duties that we give it to do. To protect the states and her people from the outside world.

Any other land that the federal government is now claiming is simply illegal. BLM, Forest Service, Bureau of Reclamation, National Parks, Monuments, Refuges, etc. have no Constitutional legality. All of the land belongs to the people, individually and collectively.

So, what about territories? Our country grew by acquiring more land through several methods. Purchase, conquests, and wars. This new land became territories. Did not the US Government own this land? What does the Constitution say? The government in America has no power in and of itself, only what we the people have given it through the Constitution. So if it can have any control or ownership of the territory, it must be in the Constitution. Article IV Section 3 Clause 2 says that Congress shall have power to dispose of and make all needful rules and regulations respecting a territory. If Congress has only the power to do what we have given it to do, and nothing else, how much of the territory can Congress retain? None of it. We only give Congress the power to dispose of it. This is to make the needful rules and regulations while it is a territory, but we know that is going to be temporary because they have to dispose of it. That is the only option that we the people gave to Congress respecting territories. Dispose of it. In other words, we do not want our Government to become powerful like the one we just had to fight with and spill our blood to become free from.

So, we are going to prevent this from happening again by NOT allowing them to retain ownership of land other than for the specific needs previously mentioned. So Congress has to dispose of territories. How is this done? Well, they could sell it, which they did with the original northwest territories, or they can give it away, which they did with the Homestead Act in the midwest, but the ultimate tool of disposal is to admit a territory into statehood because as already explained, it enters into the union on equal footing with the original 13 states and equal to all other states in the world. Retaining nothing- all of the land transfers in ownership to the state and her people the instant it becomes a state. Not one square foot is legally retained by Congress. To do so would be against the Supreme law of the Land. (end of introduction)

Dear Senator Lee:

I am pleased to address you from the depths of hell where I am located. My heart longs for the freedom of our God, and our founding fathers want us to have. I am not here by crime, for I have committed none. I am here because Congress has committed crime that they are not willing to admit, nor repent of – a crime against our Founding Fathers, a crime against our Supreme Law of the land. The Constitution of the United States of America, that espouses in it the liberty our Heavenly Maker intended our land to possess. A land of liberty and freedom for all. Congress has allowed our Supreme Law to be subverted, bypassed, and ignored until it is hardly recognized at all, rarely spoken of, and mostly despised when mentioned in the halls of Congress or in political arenas. Our Executive Branch ignores it, our Judicial Branch avoids it. Using in its place judicial rulings of their own making.

Our Founding Fathers expected better of their posterity. They expected us to be purer and more reliant upon our God, who had just rescued this land from such an oppressive Government. ( He suggests singing the last verse of the star spangled banner)…in George Washington’s farewell address he said, “of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable support….pillars of happiness…where is the security for property, for reputation, for life if the sense of moral and religious obligation are deserted?”

John Adams said, “ Our Constitution was made only for a moral and religious people. It is wholly inadequate to the Government of any other.” Thomas Jefferson said’ “In question of power…bind the Government down from mischief by the chains of the Constitution.”

We find ourselves in a similar situation that our founding fathers did, except this time we brought it upon ourselves. We did not adhere to the proper form of Government that they laid out for us. We have allowed amendments to it that diametrically change it, we have abandoned its original intent, and allowed Congress to pass numerous acts that do not pursue it, as is required in Article VI Clause 2. We have, as a Nation, abandoned God, religion, and morality. We kill our unborn, and glorify immorality and homosexuality. Is it any wonder we are having trouble and engaged in perpetual war?

Our freedoms are not being lost on the battlefields of foreign lands, but rather in our own homes, right in front of our faces.

My family and I did not set out to cause trouble. We are simple people who simply want to live in peace. To live, and let live, while we provide for our families, and participate in normal community activities. But, we were not allowed to live this way. This Government, our own Government, whose responsibility it is to protect our rights from criminals who would violate them, have become those very criminals. They have set out to take all that we have. To leave our families homeless on the streets, and they want our lives, our liberty, and our property. They have already taken the life of one of America’s best men, LaVoy Finicum. There are not many who are better than he, and yet they killed him without thought. They did not consider my life any more, placing bullets intended to kill in my direction. Only by the protection from heaven did I make it through with but only one hole in me. Now they intend on taking all of our lives by locking us away for the rest of them. Why?? Because they do not want America to be free. Because they do not want us to teach America what our Founders set up. They do not want to lose the power that they have gained. Knowledge of our Constitution would cause their illegitimate power to be challenged and brought to an end. No, they could not allow that. They had to put a stop to it. So, they attacked us, killed us, and charged us with all manner of crimes. Calling good evil, and evil good. They had to shut us up. The same has happened in history.

So, here I sit, in jail falsely accused. I have written this letter with a pencil that’s not but 2 inches long, and I have had to sharpen it with my teeth to keep writing. I have spent three months now in a cell not larger than the inside of a family van. I have been subject to bodily searches every day, and numerous other humiliating indignities. Not one of our Constitutional rights is being honored, and yet we call this the Land of the Free. Is it worth it? Damn right it is. Our Founders pledged their very lives, fortunes, and sacred honor for the cause of freedom in America you are not willing to sacrifice the same, you don’t deserve it. Many died in the War for Independence, some of those very ones who had made the pledge died. Death and sacrifice is not required of us all, but the willingness to do so is required.

So, what are you going to do? Are you going to go about your lives as you always have been? Playing politics? Or, are you going to quit worrying about what party a person belongs to and start qualifying a person by how well they will uphold the Constitution? Maybe by who will bring freedom back to this state and back to this people. Stop playing games, put your foot down, and take what is ours..our land and our resources, and many other things. Expel the illegitimate agencies from your state. Senators and Congressmen, you can still fix this, and it is yours to do. Drop your claim on the land that rightfully belongs to the states, beg the people’s forgiveness, and restrain your acts to Constitutional pursuits. Check the Executive and Judicial branches as is designed. The three branches are supposed to be at enmity with one another constantly checking the others. Protect the people as you are supposed to do. Do not destroy them as you have been doing. Release us all from these prison walls for having to do your job.

Above all, rely on the hand of Divine Providence, and follow the spirit of the Lord in all that you do. That is all that we have said and done. The Lord said to us “go into the wildlife refuge and wake the people up.” This was not an easy instruction that we received. We had nothing to gain. It was far from our homes and families. But, we could see what our Government was doing to the Hammond family, we could see that if the Government was allowed to get away with destroying a family in this way, it would be a type and a shadow of what would become normal. If anyone dare challenge the federal agencies they would be charged and tried as terrorists as the Hammond’s were.

Is that what this country has come to? It sounds a whole lot like communism to me.
So we did as we were commanded to do. We went into the refuge to wake the people up. I sure hope that you are awake because it has not been very fun for me or any of the other forty seven of us in here. That is right…they are holding forty seven patriots of America as political prisoners for doing what every American should be doing. Hundreds more followed the spirit of the Lord as did these 47 to come in support of an America in distress. These hundreds are also at risk of being arrested by federal agents. More arrests are being made. Are you going to stand idly by and let Nazi-like tactics take place in your country?

Stand up America…it is time.

It was prophesied by Joseph Smith that the Constitution would hang as if it were by a thread. That IF it were to be saved, it would be this people. The Elders of Israel and other good men and women who would bring it forth out of obscurity. That prophecy is unfolding now, for our Constitution is certainly hanging by not much more than a thread. What are you going to do about it?

I have a bright picture of hope for our future. The Lord led us to where we are now. I believe He will bring us back home as well. I surely do miss my little ones. I believe that we will enjoy freedom again. Personally and collectively as a country, but it is going to take some work and commitment on your part. We can’t just lean back and let God do it all alone. He can, but he holds us accountable and expects us to do good works of our own free will and choice. So go and do something good today.

It has been over three months now that Ryan and his three brothers and father have been in jail. And NO RESPONSE from their elected officials since April 23, 2016 on this letter. This is unbelievable.

This is why I say that the Constitution that Senator Mike Lee professes to defend will never be fixed in Washington DC where he hangs out. Government will not solve this problem of over-reach because government IS the problem.

The Bundy brothers and others who were either at the Bundy Ranch in 2014 or at the Refuge in 2016 are all charged with fabricated crimes, felonies that will keep them in prison for years, if convicted, and for exercising their First Amendment and Second Amendment rights, they were arrested and put into solitary confinement without bail (a violation of their Eighth Amendment rights). They have no assurance of their Sixth Amendment right to a speedy trial – they can’t even access their attorneys long enough to put their cases together when they’re in solitary confinement, which also violates their Fifth Amendment right to due process and a Grand Jury. They were never served a warrant for arrest (with plenty of opportunities to do so either in Bunkerville or Burns) and they have not been given their Seventh Amendment right to a common law court and jury.

There’s not much more left to the Bill of Rights, is there?…Only the Third (the quartering of soldiers in private homes), and Ninth and Tenth (which apply to state sovereignty) remain.

And THAT, my friends is why I have been ranting on my radio show that, No, the Constitution is NOT hanging by a thread – It’s severed.

Solitary Confinement for Patriots: LaVoy’s Daughter Thara Shocks the Conscience

Watch this video.  LaVoy Finicum’s daughter Thara Tenney shocks the conscience with how the Patriots of Malheur are being treated in Oregon and Nevada jails. Just a few days ago, Ryan Bundy was sent back to solitary confinement.  His crime?  He was freezing and put on an extra shirt.  That was against the “rules.”

They are informed that as prisoners that have not been convicted, they have NO constitutional rights.  Where did this perverted view of the US Constitution come from?

The Patriots of Malheur have not been convicted of any crime.  They have been charged with conspiracy against the U.S. government for standing on the FACT that our own government is violating its rule of law – the U.S. Constitution.

What is happening in Oregon?  From the Governor, to the County Sheriff, right down to the jail warden, evil, elected officials and unelected bureaucrats are strategically torturing these political prisoners for standing on the U.S. Constitution and their First Amendment right to peacefully protest and to protect themselves in that process with their Second Amendment right.

No Patriot of Malheur EVER brandished or pointed or even threatened with a gun.  Agent provocateurs and other imposters may have, but THESE men and women did not.

So why is the torture of solitary confinement being inflicted on them, when no Court has found them guilty or convicted them of any crime?

The reason for torture is to break down the prisoner’s will and to coerce them to agree to a plea bargain for a lesser charge.

But these political prisoners are NOT guilty of any felony charges!

The real law breakers are these elected officials, the unelected bureaucrats, the Court system filled with corrupt judges, and the jail wardens who do their bidding.

What has happened to the Constitutionally-protected right to peacefully assemble?  (Amendment 1)

What has happened to the Constitutionally-protected right to be part of an organized militia and to bear arms? (Amendment 2)

What has happened to the Constitutionally-protected right of unlawful searches and seizures? (Amendment 4)

What has happened to the Constitutionally-protected prohibition of excessive bail? There is NO bail here.  (Amendment 8)

What has happened to the Constitutionally-protected prohibition of cruel and unusual punishment?  Solitary confinement.  No pre-trial release. For prisoners who have NOT even been tried by a jury?  (Amendment 8)

What has happened to the Constitutionally-protected right to a speedy trial?  They’ve been in jail for nearly THREE months and arraignment and jurisdiction hearings have barely begun.

What has happened to the Constitutionally-protected jurisprudence founded in common law that presumes innocence until proven guilty by trial by jury? (Amendment 7)

These patriots have not yet had a trial.  Yet they have been unlawfully detained nearly three months and are being treated like animals.

Where is their right to due process?  The Oregon judge has just extradited the Patriots who showed up at the 2014 Bundy Ranch peaceful standoff to a Nevada jail and Court.  

How do you even speak to your attorney if you are being detained in solitary confinement? How do you get your legal defense in order?  You are denied paper and pencil if you do not “behave.”

And if you get out of solitary, and you are found with TWO pencils, you are breaking the rules and you are sent back to solitary.

And did you know that you your family – now without its income source – must pay $1 a minute (international rate)?  The government contractor that our elected officials have selected (crony capitalism or fascism) is ripping off the families of people who are suffering.

Where is their right to being treated humanely?

All of this is prohibited in the U.S. Constitution.  READ THE CONSTITUTION!

It is unconstitutional for the government to treat any citizen with cruel and unusual punishment.  If this is not, then what is?  Have you watched one too many violent movies or played too many violent video games that you are numb to this inhumanity?

I confess I had no idea what was happening in our own prisons, and I had no idea that Oregon had become a marxist tyrannical state.  This experience that began on January 2, 2016 has OPENED OUR EYES and the murder of LaVoy Finicum on January 26, 2016 has CHANGED MY VIEW.

A Tale of Two Constitutions

So why are all these patriots in jail without bond and why is this invasion of private property rights happening?

Since the US Constitution was adopted, forces to amend it to make it something it was not intended to be have been hard at work to destroy the meaning of this document.  The two sides are in a tug of war, one side being the original view and the other the living view.  The labels are “constitutional originalism” and “living constitutionalism.”

Justice Antonin Scalia was an “originalist.”  He said, “My burden is not to show that originalism is perfect, but that it beats the other alternatives, and that, believe me, is not difficult.”

In early January I was overcome with a desire to help a rancher and his friends that the media misrepresented so badly, that you were not allowed to know them as they really were and what they were doing, and as I know the spokesman, LaVoy Finicum, to be.

Family members that were able to travel the distance visited him at the refuge. They knew in their hearts they may have said their last goodbye to their father, husband and brother.

He had told them ever since the events at the Bundy Ranch in 2014 that liberty was more valuable than life, and he was willing to die for it, if necessary.

They prayed together one last time and said their goodbyes.

It was not long after that he was murdered in an ambush on a lonely highway, left alone to die in the snow.

The slow motion video shows, after several shots had been fired at him, that he had both hands up when they gunned him down.

For what?

He was standing on his belief that the U.S. Constitution, an inspired document, was in tatters, and he needed to do something to wake people up.

Throughout ancient Biblical and contemporary history, acts of civil disobedience have indeed changed the course of history. They are always controversial and met with much criticism.

We now know that those were shots heard around the world. Over two months later, we also know they have awakened many and they are changing the course of history.

Yes it was controversial, as those events typically are. Others were arrested and sent to jail, given sentences so cruel and unusual as to put them into solitary confinement, throw food to them on the dirty floor, and for those who belong to a religion that has defended marriage between a man and a woman, they clothed them in pink. They are charged with multiple felonies so egregious as “conspiracy” that threaten to condemn them to prison for life and beyond the years they even have remaining on this earth. They are apparently worse than a rapist.

Yes, they were exercising their First and Second Amendment rights to free speech and to carry a gun for protection. But they were not the violent ones at the refuge. In fact, they never brandished a gun at a soul. It was a non-violent protest.

They were standing in solidarity for their rancher friends, Dwight (73) and Steven Hammond (46), a father and son serving a second term in prison (double jeopardy – illegal) for “arson” and with former charges of “domestic terrorism.”

A sheriff that was criticized for speaking out too strongly about the “federal government over reach” and that is the sheriff of a county the police report called a “U.N. Free Zone” and the reason they could not stage the ambush there, is now under a criminal investigation by the Department of Justice for his views and actions to help the protestors to arrange a meeting in his county. Meanwhile, the vulnerable – their wives and children – have been left behind intentionally to break the will of the leaders of a movement that has risen out of years of unsuccessful appeals for redress. An over-reaching central government considers this a great enough threat that the this same tyrant – the federal government – is demanding these people pay the price.

While at the refuge, these good men – faithful to their wives and children – were called “domestic terrorists” – “anti-government militants” and “leaders of the militia” and under the regulations and definitions of the Department of Homeland Security and its “domestic terrorist list” they are “guilty as charged.” (Documentation on the Facebook page.)

LaVoy Finicum was never the leader of a militia, even though militias are protected under the Second Amendment. He was a rancher and a leader of ranchers who have suffered enormous regulations that make ranching a dying industry in the U.S. This is about our food supply and our liberty to access our land and own it and work it.

Their families and friends continue to mourn for the enormous losses. Children cry out for their daddies. Their wives are left behind to courageously lead. These are strong women and they are not allowing this to get them down. Their children are being taught the courage of their parents.

Some citizens are confused by the media coverage. Others are deceived. A few know the truth. Overall, many have preferred to sideline quarterback, condemn, and shun.

Regardless what you believe – whether these are saints or sinners – one man showed absolute Christlike love. He traveled to the ranch recently to return the Bible that belonged to LaVoy Finicum, who many loved and followed for the principles he lived and taught.

His name was Reverend Franklin Graham. I will share more about this amazing story later. But for now, as I said, I need your help.

I need to get to Portland, Oregon in a couple of days to visit Ammon and Ryan Bundy in jail, deliver them some U.S. Constitutions, to meet with the media there and to get eyewitness testimony and show our love and our support at their Court hearing on Wednesday, April 6, 2016. All 22 from the Malheur Refuge will be there.

The Judge will decide whether they will stay in the Portland, Oregon jail or whether they will be transported to Las Vegas and then back to Oregon. They have appealed to stay in Oregon. I don’t have time to go into details, but please, please, please… we need your help right now.

At LaVoy’s funeral, we sang one of his favorite hymns. I became so choked up I could not go on when we began to sing Verse 5.

But now it’s Verse 6 that motivates me.

The message from our Judeo-Christian heritage is clear: “Inasmuch as ye have done it unto the least of these, my brethren, ye have done it unto me.” Matt. 25:40

Oregon Police Admit Body Cams Turned off | Accuse FBI of Misconduct

On March 8, 2016, Oregon State Police held a news conference in which the DesChutes County investigative team announced its investigative report. It was a dog and pony show that turned sour. In short, it’s a huge cover up. It’s state law that police must turn on their body cams at times such as this. But instead they deliberately turned them off. This is a trend nationwide.

In addition the OSP turned on the FBI because shots were fired prematurely and were not accounted for.

In reviewing the autopsy, omissions were apparent and then upon review of the 360 page written report, strange inconsistencies appeared. One includes the mysterious Mark McConnell. Suspected by the protestors to be an FBI plant, he insisted on driving the group to the John Day meeting, and then when they encountered the ambush, his main concern was whether his Jeep had been harmed, not the man lying dead on the ground.

Furthermore, he was the only one of the group not detained and his name is entirely missing in the very detailed police report.

Another alarming detailed jumped out of the report: One police officer said they changed the kill stop (also called a deadman’s blockade), never used on civilians, from Grant County to Harney because Grant was a “UN-free Zone.” WE will be reporting more on what exactly that officer meant in our next update.

LaVoy’s widow Jeanette gave this statement after review of the investigative report:

March 9, 2016, St. George, UT — Yesterday a tag-team of law enforcement officials announced they have found that the Oregon officer who shot my husband dead while he had his hands in the air was justified. These officials announced that “without a doubt” the officer who killed my husband did so “to protect” himself and his fellow officers “from imminent harm.”

I know my husband, Robert LaVoy Finicum, and I knew him on the day he died. With his hands in the air, he was no danger to anyone, he intended no “imminent harm.” He was giving himself up in order to divert shooters from the others in the truck. Right down to the very last act of his life, he was giving for others. That was my husband. That was the man who the panel of investigators concluded was “responsible for” the situation in which he was killed in a well-planned ambush.

My family and I reject the biased, whitewash findings and conclusion reported yesterday. My lawyers have assured me that the men who ambushed my husband, who set him up for death, who assassinated him, will face justice in a court before an unbiased jury that will be deciding whether my husband was killed by a wrongful action or omission on the part of the police. That action will be joined with an action based on violation of the due process clause of the United States Constitution, the very document for which my husband gave his life. That is a Civil Rights Act claim.

Prior to yesterday the FBI held the position that my husband was shot during a “traffic stop.” That was such a stretch of the truth that even the tag-team news conference group could not repeat it. There was no “traffic stop.” This was an ambush by use of a “Deadman’s Blockade” designed to allow a “Kill Stop”—a roadblock on a blind curve on an almost abandoned road.

Those officers at the roadblock were the last line available to block the truck LaVoy drove, to assure that he was killed. In our wrongful death and civil rights violation lawsuit we will prove the kind of man my husband was, and that as a leading spokesman of this movement to restore the U.S. Constitution and our unalienable rights, he had to be made an example: “Don’t interfere if we as law officers are depriving someone of their rights, property and person.” Is this what Americans believe? Or is this the kind of fear tactic despots in the Middle East have used for centuries when they place crucifixes along the highway to strike fear into their slaves – don’t you dare oppose our unjust laws or this is what will happen to you!”

I don’t think so. Not in America. I still believe we are governed by the same Constitution that our founders created and that we are a republic, one nation under God.

Yesterday, as before, the officers set up a false scenario that my husband was reaching for a loaded gun as he was shot. Before yesterday’s selectively edited video showing, we saw the uncut version. In that uncut version, we see my husband with his hands up, walking away from the truck and not reaching for anything when a man to the right of the video obviously fired some projectile at him. Immediately he leaned over to his left hip area where it appeared some projectile hit him. At that one moment, shots were reigned down on him and he died there in the snow bank—where he lay for ten minutes without anyone checking to see whether he was alive. They let him lay there because they knew that the three shots into the back had killed him.

My attorneys have already begun to assemble a trial team of investigators, paralegals, videographers and writers to make sure that the man who shot my husband in the back and all those who were accomplices will face justice. They will soon be filing the Oregon 30.275 notice that precedes a lawsuit for wrongful death and civil rights violations.

At least twice yesterday the officials blamed my husband for being solely responsible for what happened at the site where he was ambushed. Again, my attorneys assure me that we can show differently, even with yesterday’s law enforcement whitewash. This tag-team said that the officers on the scene where the killing took place were there, putting themselves in harm’s way as part of an effort to “bring the situation at the refuge to an end peacefully.” This statement is consistent with the goal law enforcement announced from the beginning in this case: Let’s just get them out of the refuge building peacefully to the outside where we can talk.

If they had been telling the truth, on January 26, they could easily have achieved their goal. They knew from an informant inside the refuge that all but four of the people inside the refuge would be leaving for several hours. That included the long trip to John Day, the meeting with Sheriff Glenn Palmer, and the ranchers’ workshop that evening on the original intent of the Constitution.

So, I ask, why didn’t the officers pull the roadblock and let the group go out peacefully to John Day? Why didn’t they choose to arrest him while at the Sheriff’s office? If they had done that, this case would have been put in the books with the peaceful ending they now claim they wanted. In fact, the Harney County Sheriff had every opportunity during their stay at the Malheur Refuge to make a peaceful arrest during the numerous conversations they had with him in Burns. My lawyers believe we can show that was not their goal because there is no better evidence of their intent than their actions.

So when the officials said yesterday that my husband was “solely responsible” for the situation and happening of his death, they were spreading their whitewash with a very broad brush. Yesterday one of the tag-team said that my husband chose to break the law, chose to put himself and other people in danger, and then chose to enter into a face-to-face confrontation with armed police officers. My lawyers have already discussed with me how the facts will show that the officers intended to shoot LaVoy, how an informant arranged for him to be in the lead truck, how the officers started shooting at the truck to force it to stop, and then finally how my husband gave himself up in order to draw attention away from the others in the truck.

Contrary to what the panel of officials “found,” my husband was not responsible for the situation that ended with his death. He is not the one who blockaded the road with a “deadman’s blockade.” He is not the one responsible for officers armed with long guns firing from behind the trees. He is not the one who chose to block himself and his friends from leaving the refuge to go out to John Day. He is not the one who lined armed personnel all along the roadway from the refuge to the blockade. No, all those actions can be laid at the feet of the officials who spoke of their innocence yesterday. They will not have to explain their actions in a preliminary hearing or at trial, because their actions were glossed over—“law officers will take care of their own” I was told. But I still had faith in the system my husband fought to protect. I was wrong.

We had no chance at justice in this investigation of law enforcement officers by other law enforcement officers, more like the fox guarding the hen house. But in a wrongful death action, coupled with a civil rights action, the shooters and their partners will make sure that the officers involved will face the same kind of music enjoyed yesterday at our expense.

Yesterday the panel said that “the troopers knew that Mr. Finicum carried a weapon on his left side. Mr. Finicum was reaching for that loaded 9mm gun when the troopers lawfully used deadly force to protect themselves and others including the trooper armed with a taser.” You all have seen the full video where it shows the trooper with the gun or taser to the right of the screen as you look toward the screen. You see my husband lean over to his left hip area immediately where he grabs for the place he was hit. The gunman turns his back on my husband and runs. Isn’t it strange that a law officer turns his back on a person he believes to be heavily armed? Not so strange if he knows that his partner intends to shoot that person in the back.

We believe they will have a hard time squaring their actions with the Attorney General’s statements when we next get into court. My attorneys tell me that we will have to get past the motion to dismiss the civil rights action, which is a motion often governed by intangibles such as, “Does the action of the state shock the conscience?” The media have called my husband a lot of names that are foreign to the peaceful man and extraordinary father of our children that I knew. We must now ask the question, “Who are the real ‘domestic terrorists here?”

We believe that this “Kill Stop” staged by government agents was barbaric, that their whitewash of this horrific incident is more worthy of an Academy Award-winning film in the fiction category and that unbiased American citizens will have their conscience shocked by the government agents’ conduct in:

• Arranging for imbedding an informant among those in the house, on the basis of the informant’s information they set up a Deadman’s Blockade and an intentional killing;

• They shot at the truck in an effort to prevent it from leaving peacefully;

• They shot at the truck after it came to a halt;

• Then they shot my husband, the father of our eleven children, as he moved away from the truck with both hands in the air;

• At the time he was seen to reach down and bend down to his left as though he had been shot or hit with a bullet or taser ray;

• As he bent down, and then tried to straighten back up he was shot three times in the back and died.

I believe, my family believes, my lawyers believe that this evidence will “shock the conscience.”

My husband, Dave Bundy, was arrested this morning by 20 FBI agents throwing smoke bombs and pointing guns at him while working on our home a short distance behind the Delta Utah Elementary School. We are unaware of anything that he has done to require such force. This is total Federal government overreach. We have a feeling he will be charged with the same charges that all the other Bundy family is being charged with even though he broke no laws to deserve this. He was simply at the Bundy Ranch for a peaceful protest. He never carried a gun. When the Las Vegas Metro Police deputy asked him to calm down the protesters, he said he would try to do the best he could. He jumped a fence to try to get the protesters to settle down. Shortly after that, the Las Vegas Metro Police asked the BLM to call it off anyway and the BLM officers started to leave. He has always been a citizen that has exercised his right to a peaceful protest. He has been an upstanding citizen of the United States. I feel his rights have been seriously violated since it looks like the federal government will put the same exact trumped up charges on all of the Bundy family without looking at their actions. There is no way he deserves this and he has done nothing to collect such trumped up charges. My 6 children and I are emotionally scared from this. All of them are in tears. They have no clue why their Dad would be treated this way. We thought citizens of the United States of America were allowed to protest the governments actions. To defend Dave Bundy and win will cost thousands and thousands of dollars. We don’t have that kind of money. He will likely not be given a fair trial without the help of the American people. Please help any peaceful way you can. If the federal government wins this case, they will feel they can arrest any american that protests against them. Please let your voices be heard loud but peacefully. I plead with the American people to not break any laws in Dave Bundy’s defense, but Please Please Please save my husband from the Federal Governments monopolistic and oppressive control. On Saturday March 5, 2016 thousands of citizens will gather in more than 30 states in rallies large and small to pay tribute to Nevada rancher LaVoy Finicum, their fallen hero and spokesman for the peaceful occupation at the Malheur National Wildlife Refuge. The attendees will also gather in support of the pardoning and release of nearly 30 arrested and political prisoners, including Nevada rancher Cliven Bundy, his sons Ammon and Ryan, the “Final Four,” a radio talk show host, and Oregon ranchers Dwight and Steven Hammond. The Finicum family is calling for a state and federal investigation of a wrongful death. LaVoy Finicum’s widow Jeanette will be speaking for the first time in this public setting at 1 PM Mountain time from the Utah State Capitol, live streamed on the LaVoy Finicum YouTube channel #IAMLaVoy #LibertyRising. Joining Mrs. Finicum on the platform are their two daughters Thara Tenney and Brittney Beck.

LaVoy and Jeanette Finicum were one of two families in Arizona granted a high-level license to foster fifty teenage boys over 20 years. Mitch Finicum testifies to the high quality parenting the eleven children and foster children received, “Our father’s death was near and dear to many hearts,” he said. He stood for liberty and lived his life in a way that showed the essence of being a free man. He welcomed all to learn, regardless of differing opinions. He showed an outpouring of love and taught that we should exercise our rights in a civil manner. Dad lived it, even laying down of his life for it. Will a man be free or will he be a slave?”

Sunday, March 6, 2016, is a National Day of Fasting and Prayer for those arrested and incarcerated and their families. Carol Bundy, wife of Nevada rancher Cliven and mother of Ammon and Ryan, who defended their constitutional property rights at their Nevada ranch in 2014 said, “We thank everyone around the world for their continued prayers and support, for waking up and realizing America is in trouble. We ask everyone to pray for America, to get a copy of the US Constitution and read it, study it, teach it. Understand the custom and culture of the West and the control the federal government has over our lands. Where in the Constitution does it give the BLM, the Forest Service, the Fish and Wildlife Service this jurisdiction?”

Finicum’s niece Jessica Fauth Edgar of Denver, Colorado, spearheaded the rallies and spoke to the organic rise of liberty-minded people everywhere who connected in a matter of days. “It is unbelievable to see how many people are coming together in such a short time to organize these rallies. Soon every state will be holding monthly town hall meetings and educational events of all types. I want to thank my Uncle LaVoy for his ultimate sacrifice that opened my eyes to the challenge our nation faces.”

On January 2, 2016, a peaceful rally drawing over 300 ranchers, sheriffs, elected officials and citizens from around the country was held in Burns, Oregon protesting the incarceration of Oregon ranchers Dwight and Steven Hammond. After the rally a group of ranchers and their supporters who follow Justice Antonin Scalia’s views on the Constitution called “originalism” or “original intent” walked into a federally managed wildlife refuge building, a legal trespass known as “hostile adverse possession,” used to “uncloud” titles. They spent their days helping citizens in the area uncover the long history of abuses and land grabs, teaching them of their Constitutional rights under original intent. They went freely to and from the refuge and the crowds increased as people came out to learn more.

On January 26, 2016 while traveling to one such event at the invitation of County Sheriff Glenn Palmer, where over 400 people waited, Mr. Finicum was assassinated with both hands up by the FBI and Oregon State Police in an illegal “deadman’s blockade” on a blind curve along a highway in eastern Oregon.

Finicum was a respected teacher of the Constitution and leader of rancher land rights in the Western states, and known as a peaceful man and beloved father of 11 children. Since that ambush, political prisoners have been held in solitary confinement for 14 days and without bail in Multnomah County Jail in Portland, Oregon. The protest began with a rally to oppose the incarceration of Oregon ranchers Dwight and Steve Hammond in Oregon’s San Pedro jail.

The constitutional question surrounding these peaceful protests is the “original intent” interpretation of the US Constitution championed by the late US Supreme Court Justice Antonin Scalia. In question is a citizen’s First Amendment free speech right to a legal trespass for the purpose of “unclouding” land title and to defend property rights from gross federal overreach.

Oregon ranchers Dwight and Steven Hammond were incarcerated on “double jeopardy,” false charges of arson and domestic terrorism, for which they had already served time. From the 2014 Bundy Ranch property defense to the peaceful protest at the Malheur National Wildlife Refuge in January 2016, citizens across the nation are rising up in support of their constitutional rights and to demand the pardoning and release of those detained and arrested here, along with an undisclosed list of many more.

LaVoy Finicum’s Widow Speaks Out About Her Husband’s Assassination by FBI

Listen to this very warm and emotional interview with Jeanette Finicum, LaVoy Finicum’s widow.  This is her first radio interview since he was assassinated on an Oregon highway while on his way to an event at the invitation of Sheriff Glenn Palmer where he was educating the townspeople about the Constitution.  LaVoy shared the same views as the late Justice Scalia – “originalism.”
